How to Look Up a Court Case in Nye County?

Finding a court record in Nye County depends on which court handled the case. The county operates two tiers of courts — the Fifth Judicial District Court and three Justice Courts — each maintaining its own records.

Fifth Judicial District Court — Clerk’s Office

Pahrump Justice Court — Online Portal

The Pahrump Justice Court provides an online portal where many records and case details can be searched without visiting the courthouse. For records not found online, the court offers a downloadable Court Records Request Form. Payments for record copies can be submitted through the court’s online payment portal.

Public Records Request — Nye County

For broader county records, Nye County accepts public records requests through its online Public Records Request Form. A downloadable version of the form is also available and can be emailed to the county. Per the Nevada Public Records Act (NRS Chapter 239), agencies must respond no later than the fifth business day after a request is received.

Are Court Records Public in Nye County?

Court records in Nye County are presumptively public under the Nevada Public Records Act, NRS Chapter 239. Under NRS 239.010, all government records are open to public inspection and copying unless specifically declared confidential by statute. This general presumption of openness covers most docket entries, judgments, orders, and case filings produced by Nye County’s courts.

However, several categories of records are withheld from public access either by court order or operation of Nevada law:

  • Sealed records — Any file sealed by court order cannot be examined without a subsequent court order authorizing access. The Clerk cannot permit inspection of sealed files under any other circumstances.
  • Juvenile records — Proceedings involving juveniles are confidential and restricted to authorized parties under Nevada law.
  • Adoption records — Adoption case files maintained by the District Court Clerk are not publicly accessible.
  • Criminal history records — Detailed criminal history information is governed by NRS Chapter 179A, which establishes the Central Repository for Nevada Records of Criminal History and limits public access to individual criminal histories.
  • Records containing private personal information — Documents that would infringe on existing privacy protections, or that contain sensitive identifying data, may be withheld or redacted before release.

The Fifth Judicial District Court does not have local court rules — the court operates under statewide Nevada court rules and procedures.

Nye County Criminal Court Records

Felony and gross misdemeanor criminal cases in Nye County are heard by the Fifth Judicial District Court, which comprises two departments. Both Department 1 (Hon. Kimberly A. Nye County Family Court Records

Family law matters — including divorce, child custody, child support, domestic relations, and paternity — are handled by the Fifth Judicial District Court. Both District Court judges preside over family cases in both Pahrump and Tonopah. The Clerk’s Office maintains all family court records including:

Accessing Family Court Records

Marriage Records

Marriage certificates are recorded and maintained by the Nye County Recorder’s Office. Copies cost $15.00 per copy. Requests can be submitted through three channels:

Birth and Death Records

Birth and death certificates for events occurring in Nevada are confidential under state law and are not available at the county level. Eligible requesters — the record owner, immediate family members, or legal representatives — must submit applications to the Nevada Division of Public and Behavioral Health (DPBH) Vital Records Office. Nye County Probate Court Records

Probate jurisdiction in Nye County rests with the Fifth Judicial District Court.
